Terms and Conditions

Information on ‘how to enter’ and the awarding of the prizes forms part of these Terms and Conditions of entry.
Employees of 3M Australia or their agencies or companies directly involved in this promotion and their immediate family members are ineligible to enter this promotion.
Entry is open to Australian residents aged 18 years or over at the time of entering the competition (“Eligible Entrant”)
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible entries will be deemed invalid.
Only one entry permitted per registration throughout the promotional period.
If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the Internet account is held.
How to Enter: a) Enter the Major Prize by registering as a member of the Desk Candy website by visiting www.deskcandy.com.au during the promotional period AND telling our Judges in 25 words or less the most colourful place you have ever been. b) Enter the Win one of 50 $100 David Jones Gift Vouchers by registering as a member of the Desk Candy website by visiting www.deskcandy.com.au during the promotional period, referring 1-5 friends or family to register to become Desk Candy website members AND telling our Judges in 25 words or less how stationery brightens your world.
Eligible Entrants should only nominate friends and family members with whom they have a direct relationship and who consent to receiving information about this type of service.
The promotion will commence on 29.09.08 at 12.01am AEST. The competition closes on 22.12.08 at 11.59pm AEDST.
Judging: will take place at 3M Australia, 950 Pacific Highway, Pymble NSW 2073. The judges will comprise a panel of 3 representatives appointed by the Promoter from 3M and its agency. This competition is a game of skill and chance plays no part in determining the winner. Each entry will be judged on creative merit and originality.
All winners will be notified by email or telephone, and the winner’s name will be posted on www.deskcandy.com.au
The Judges and the Promoter’s decision are final and no correspondence will be entered into. Entries not received by the closing time and date or not completed in accordance with these conditions will not be eligible to win.
The Major Prize: is a twelve (12) day/ eleven (11) nights round trip for two (2) adults to Brazil. The prize includes:
- economy airfares for two (2) adults from the winner’s capital city to Sydney (if necessary), from Sydney to Buenos Aires, from Buenos Aires to Sydney and from Sydney to the winner’s capital city (if necessary);
- a round trip from Buenos Aires, to Iguassu Falls, to Rio, and to Buenos Aires, with limited transfers included;
- twin share accommodation at a 3-4 star room, as determined by the Promoter, in its absolute discretion;
- travel visa for the winner and his/her companion; and
- AUD$1,000 spending money per person.
Frequent Flyer points will not be rewarded on these airfares. Meals, further spending money, additional transfers, insurance, passports, additional visas, vaccinations, transport to and from departure point, in-room charges and all other ancillary costs are the responsibility of the winner. The winner will be responsible for all incidental costs not listed in these terms and conditions incurred with taking this prize. Flights and accommodation are subject to booking and availability. Prize must be taken within 12 months from announcing the winner however, travel is subject to seasonality and prize cannot be taken during peak season travel, as well as Australian school holidays and public holidays. Total prize valued at up to AUD$14,980 depending on date and point of departure.
The winner (and his/her companion) is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner (and his/her companion) must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present a credit card at time of accommodation check in.
If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
Win one of 50 $100 David Jones Gift Voucher Prizes: Any ancillary costs associated with redeeming the David Jones voucher are not included. Any unused balance of the David Jones voucher will not be awarded as cash. Redemption of the David Jones voucher is subject to any terms and conditions of the issuer including those specified on the David Jones voucher.
Prizes are not transferable, exchangeable and cannot be taken as cash. The Promoter takes no responsibility for any diminution in prize value. The Promoter will use its best endeavours to provide the prizes. If any prize (or part of any prize) is unavailable due to difficulties such as destruction of destination or deletion of an item, the Promoter to provide an alternative prize to the equivalent value and/or specification, subject to any written directions from a regulatory authority.
If for any reason a winner does not take the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; or (e) use of a prize.
As a condition of accepting a prize, the winner (and his/her companion, if applicable) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings or by entering into the promotion. Independent financial advice should be sought by the winner or Eligible Entrant.
The Promoter is not responsible for any problems including technical malfunction of any telephone network or lines, printing errors, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting in or downloading any materials in this competition.
If for any reason this competition is interfered in any way and is not capable of running as planned including infection by bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate; or (c) cancel or suspend all or any of the promotion.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
By entering the promotion, each Eligible Entrant (unless they advise the Promoter otherwise) consents to the information they submit with their entry being entered into a database and the Promoter may, for an indefinite period, unless otherwise advised, use this information in any media for future promotional, marketing, publicity research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant without any further reference or payment or other compensation to the Eligible Entrant. All personal details of the Eligible Entrants provided by entering the promotion will be stored on the server at ICO – a division of ITX Group Limited, 15 Talavera Road, North Ryde NSW 2113.
